Terms of Service: Your Legal Agreement with HotCougar

1. Acceptance of Terms

By accessing or using the HotCougar website, mobile application, or any associated services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a binding legal agreement between you ("User") and HotCougar Network ("we," "us," or "our").

You understand and agree that:

• We may modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.
• You are solely responsible for your interactions with other Users.

3. User Responsibilities

3.1 Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you have the legal capacity to enter into this agreement.

3.2 Account Integrity

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update it promptly.

3.3 Acceptable Use

You agree not to use the Platform to:

1. Violate any applicable local, state, national, or international law.
2. Harass, abuse, threaten, or intimidate any other User.
3. Post or transmit any content that is unlawful, defamatory, obscene, invasive of privacy, or infringing of intellectual property rights.
4. Impersonate any person or entity, or falsely state your affiliation.
5. Use automated scripts, bots, scrapers, or other unauthorized means to access the Platform or collect data.
6. Interfere with or disrupt the integrity or performance of the Platform.
7. Attempt to gain unauthorized access to any part of the Platform or its related systems.

4. Intellectual Property

All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof (the "Content"), is the exclusive property of HotCougar Network or its licensors and is protected by copyright, trademark, and other intellectual property laws.

The "HotCougar" name and logo are registered trademarks. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for personal use only. You may not copy, modify, distribute, sell, or lease any part of our Platform or Content without our express written permission.

You retain ownership of any content you submit, post, or display ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, and display such content to operate and promote the Platform.

5. Limitation of Liability

To the fullest extent permitted by applicable law, HotCougar Network, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform.
• Any conduct or content of any third party on the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any other matter relating to the Platform.

Our total cumulative liability to you for all claims arising from or related to the Platform shall not exceed the amount you have paid to us, if any, in the twelve (12) months preceding the event giving rise to the liability, or one hundred US dollars (USD $100), whichever is greater.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, secure, error-free, or free from harmful components. We do not warrant the accuracy, completeness, or reliability of any content or communications on the Platform. Your use of the Platform and any reliance on content is solely at your own risk.

7. Termination

We may, at our sole discretion, suspend or terminate your account and access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other Users, to us, or for any other reason.

You may terminate your account at any time by contacting us or using the account deletion tools within the Platform. Upon termination, your right to use the Platform will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the federal or state courts located in Wilmington, Delaware. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We reserve the right to revise these Terms at our sole discretion at any time. When we make changes, we will post the updated Terms on this page and update the "Last Updated" date.
